20180416_Article 29 WP Guidelines on Consent_publish.pdf (280 Kb) On May 5, 2020, the European Data Protection Board (EDPB) published a slightly updated version of the WP 29 (i.e. former EDPB) guidelines on the GDPR consent of April 10, 2018. The EDPB has provided further clarifications regarding: – The validity of consent provided by the data subject when interacting with “cookie walls”; Prior to the GDPR, consent has traditionally been considered appropriate for research purposes, but the EDPB has warned against using consent as a default ground because: • Consent needs to be freely given and there are many circumstances in which this is not the cas e, The EDPB’s guidance is the first assessment of some of the issues resulting from the interplay between PSD2 and GDPR. While the guidance is not exhaustive, and some issues certainly remain, it does provide a welcomed clarification that the notion of explicit consent under PSD2 must be seen as separate and different from the notion of (explicit) consent under GDPR.

According to the EDPB, consent under the GDPR and the CTR are different, and GDPR consent is not the panacea, but it can be relied on after a careful factual assessment. It will be interesting to see if and how market practices will evolve in light of this EDPB Opinion.

The new Guidance builds on both of those previous papers, and also refers back to historic EDPB and Article 29 Working Party (the predecessor to the EDPB) guidance on issues such as consent. Importantly, the EDPB also confirms that the Guidance will be followed up, later this year, by a more detailed set of guidelines on scientific research which will elaborate on many of the points made in On May 4, 2020, the European Data Protection Board (EDPB) adopted updated guidelines on consent under the General Data Protection Regulation (GDPR), in Guidelines 05/2020.

Theoretically, a person’s consent is indefinite, though there might be situations in which it becomes clear that consent is no longer valid or reasonable, or violates some principle of data processing . It adopts guidelines for complying with the requirements of the UK GDPR. EDPB guidelines are no longer be directly relevant to the UK regime and will are not binding under the UK regime.
